Legal Question in Consumer Law in California

deceptive salesman

I purchased a BBQ island from a store and was told by the salesman that I could return it if it didn't fit. I never took it from the store. Nothing was custom made. I signed a sales agreement which said''All Sales Final''. I never saw that phrase as I believe it was covered up as I signed it. The slaeman told me one thing and I believed him. My credit union reversed the charge as I never took possession of the product because I discovered that it was the wrong size for my yard. The saleman wrote on my receipt,''Process a Refund''. However he never did process the refund, so I was forced to call my credit union. Three weeks later he called the credit union to charge me a restocking fee of 30%. The slaeman was very deceptive from the beginning assuring me I could return it. I am suing the company. Do I have recourse against a deceptive salesperson? This business is desperate for sales. Thank you for your response.

Re: deceptive salesman

Read The Friendly Contract. They are desperate for sales? You must be desperate to buy stuff if you're in the habit of signing contracts without reading them.

What the salesman told you has no legal effect -- only what's in the written contract that you signed.
