Legal Question in Consumer Law in California

An independent contractor was not paid $75 for the work he did, the client agreed to pay and then refused to pay after the work was completed. Can the independent contractor sue for more then $75? If possible he would like to sue for punitive damages, is that something that can be awarded in this case? If so what evidence would be required?
