Insurance Canceled by insurance agency by mistake

I had a car insurance policy that started on May/2003 and was canceled with no notification on August/2003.

Because I have not been notified by the insurance company,since August/2003 I have been driving unaware that my policy was canceled.

Last Saturday (12/6/2003) I gotr in a car accident. I was coming on 2nd Avenue and stopt in the stop sign; however, I didn't notice that the cross street (Cabrillo St.) didn't have a stop sign so that I counted on the other driver to stop, what didn't happen and the other driver, who was drivin in high speed, hit my car.

None of us got any ticket from the police or any of us was targeted as guilty for the accident. Also, both of us had a AAA insurance.

When I called my insurance, they said my policy was canceled. I asked why and they found out it was a mistake and they were willing to reactivate my policy but, in order to do so I would need to sign some documents among which was a declaration of not been involved in at-faul accident.

My question is how should I proceed with the insurance company. Should they take responsibility for my policy been canceled? How can I get them to cover both cars since I consider both of us have AAA insurance and partial fault at the accident.

As long as the premiums were paid as agreed, you do not have to sign anything.
