Legal Question in Consumer Law in California

Laminate flooring

On April 20th 2003 we paid Home Depot the amount of 2887.41 for the Shaw laminate flooring . They sub contracted it to House of floors. They did not bring any moisture meters and simply took the carpet and installed the flooring. We were unhappy because the floor was uneven and creaky and so complained in January of 2004. So House of floors came and cut an inch near the wall on all sides on February 9th and said that it happened because it did not have place to expand and in 8 weeks I should expect a even floor. In 8 weeks the experts came and checked the floor and said that there are only two possible reasons for the uneven, creaky floor (1) Product defect (2) their workman defect. They said that they will re do the whole floor. This time they brought moisture meters and removed the entire laminate flooring and measured the moisture. They said that the moisture content is more than 6 and so they are not going to install the floor and they left me with a concrete floor. I called several people who deal with carpet and laminate flooring and they said that they always measure moisture prior to installation. We have spent $1500 more and got the carpet installed and it is fine. Can I get my money back from Home Depot?

Re: Laminate flooring

Probably. If they refuse to refund the money and pay you the $1,500.00 for your out-of-pocket expenses, sue them in small claims court.
