post office forwarded my mail to exhusband

My ex moved out of the residence about 1 year ago. I discoverd that his mother put in a change of address for their family to forward all my mail to their home in Arizona.

I spoke to the postmaster on several occassions when I was not receiving any of my mail. I had utilities turned off, I lost out on court dates, I lost my credit rating when my credit card statements were forwarded out of state.

I want to sue to the post office for violating my rights to receive my mail and restore my credibility with my credit card companies.

First, suing the Postal Service is not going to restore your credibility with your credit card companies. Next, in order to win any lawsuit against the Postal Service, you are going to be required to prove that they knew that the change of address was made by someone other than you, which would be difficult at best. Think about it, how could the Postal Service know that the change of address order did not come from you? I doubt they have any obligation to verify that a change of address is being submitted by the person to whom it relates. Finally, an element of every lawsuit is that the person suing has been damaged, i.e., has lost money. Moreover, as a general rule, the person being sued must be the person causing the damage.

If anyone could be sued in this instance, it would probably be your ex-mother-in-law because it sounds as if she is the person who caused your damages. If she lives in Arizona, you would have to sue her in an Arizona court.
