Legal Question in Consumer Law in California

I am unable to get any satisfaction from GoWireless, Inc. and wish to file a small claim court action. I live in CA and the SOS has an Agent for Service of Process in Sacramento CA. GoWireless, Inc. is a NV Corp.

Do I file with the Agent for Service of Process or do I serve the local store where the transaction took place.

I have called their CSR's who have promised to call back but have not. All they say is that they are looking into the issue.

I left a voice message at the local store and did not get a call back and I also dropped off a personal letter to the store manager who has failed to contact me.

GoWireless is a preferred Verizon Retailer.

I called Verizon and they tell me that only the GoWireless Store can solve the issues or I can take care of them with Verizon directly for a cost of about $500 including a termination fee for a phone number that GoWireless created without my knowledge and has no connected device and never has or will have a connected device.

If your issue is the unauthorized creation of an account or number, you can't get relief in small claims anyway. To answer your specific question, however, whatever legal proceedings you DO initiate will best be served on the Agent for Service of Process. Serving the local store may or may not be effective service, but serving the ASP is ALWAYS valid service. So it's the obvious best option.
