Legal Question in Consumer Law in California

Our wedding photographer has never given us the pictures we payed for, and signed a contract with him. Our wedding was last year August 2, 2008. He has moved to Vancouver, BC since then. He last responded that he will send the photos on July 20, 2009. He is now not answering our calls. What can I do to get the photos? Can I take him to small claims court in Canada? I'm definitely making a report to Canadian BBB. Any advice would be helpful. Thank you.

That's awful! It would probably be worthwhile to do that. But what are you going to get besides your money, if that. I hope you had relatives and friends who snapped photos that you can assemble for your album.

Definitely, this person should not be in this business. It's such a heartbreak not to have your wedding photos. You might call a solicitor in BC to call on this guy and see if you can get someone to shake a tree up there. Good luck!

Why sue him in Canada when you can sue him here where the work was done or the contract entered into? Sue him here because you have jurisdiction over him based on either where work to be preformed or contract was entered into. Get a judgment against him and then get a Canadian lawyer in British Columbia to enforce the judgment. That should convince him to cough up the pictures because he will not want to come back here to deal with your case.
