Legal Question in Credit and Debt Law in California

collection

I received a letter stating that I had already lost a case filed against me from a credit card company. I was never contacted by phone or mail about the debt that I had to pay. Currently my employers are deducting my pay because the court has ordered them to do so.The interest rate is so high and my hours at work is so low that I would never be able to pay it off. What advice can you give me as far as trying to settle or giving me other options of pay offs are concerned.Like mentioned, I was never given any warning about the whole ordeal. Any help would be appreciated.

If judgment occurred within the last 6 months, you might be able to set it aside based upon not being served with the lawsuit. You should immediately consult with an attorney in your area to assist you.

As Mr. Cohen said, you can probably get it set aside within 6 months. I would get down to the courthouse and get a copy of it. Once you have it, you can then determine what your next step should be. You probably want to talk to an attorney who assists debtors or consumers ASAP.
