Legal Question in Credit and Debt Law in California

Executor also joint tenant after death responsibility

There is a death. All money is in joint tenancy. That person is also the executor. Does theoney pass to him right away or must he as the resonsible executor keep the money to pay medical bill? If they were twom separtate people I assume the money would pass automatically and then there would be no money left for payment of bills. Correct

Re: Executor also joint tenant after death responsibility

The nature of a joint tenancy is that the property passes to the survivor without much ado. If I were the survivor, I would argue that the money becomes mine upon the joint tenant's death, and therefore the medical provider can't even try to get that money since it would be mine.
