what happened if try to file small claims on someone who owes you like 100.00? doesnt it cost you a lot of money to file? what happens, who pays, or is it better to file out of court?

Hello:

The California Small Claims court can hear claims under $7,500. Over that amount, and it is out of their jurisdiction. The commissioner of the SC will either dismiss the case, or the clerk will dismiss the case, or if no one raises the issue, they'll pass judgment on the issue but they really shouldn't have done so-Their judgment could be overturned because it was outside the court's SC jurisdiction.

It would cost you $75 to file that suit because of the amount you are seeking.

$225 to file in Limited Civil Jurisdiction and $495 thereafter in Unlimited Civil Jurisdiction.

Always better to try and settle these things outside of court.
