Legal Question in Credit and Debt Law in California

I have received a money judgement against me from credit card companies. I live in California. Can they take and sell my car? What else can they do besides garnish my little bit of wages?

From our experience in representing debtors for our local bar association's pro bone free)program here are my thoughts. Possibly, subject to whatever exemption you have available. They can also levy your bank accounts. Your creditor can also subject you to an interview under oath at the local courthouse to discuss what assets you have. This is called an order of examination and they can do one every six months I would suggest that you contact an attorney immediately or if you cannot afford one call either the local bar association and ask if they have or know of any legal aid programs.

Generally speaking even at this stage you could probably still set up a payment program with your creditor. It doesn't hurt to ask because they should realize how difficult it would be for them to collect if you have minimal assets and little earnings. In addition you should be aware if your wages are garnished your employer must give you a copy of the garnishment and you have an opportunity to file an object and exemption in court., but you will have to act quickly. There are instructions on the back of the form to help you.
