Legal Question in Credit and Debt Law in California

Hi, I received Summons , being sued in Small Claims in California, I never received a demand letter, can I ask the judge to dismiss now or before the hearing date? And should I do it before or on hearing date?

Failure to receive a demand letter is not a legal basis for dismissal of a small claims action. Small claims is very informal and you should focus on putting together your witnesses and evidence instead of minor procedural issues. A judge would be very reluctant to dismiss the case.
