Legal Question in Credit and Debt Law in California

I am a small business owner and I have defaulted on merchant cash advance loans. My lender has threatened to file a criminal lawsuit. This is an unsecured loan. What is the truth to this?

Unless you stole money, embezzled it or are guilty of fraud, the local prosecutor won't be interested in case. This is civil matter and the prosecutor would tell the lender to file a lawsuit. You should, however, consider seeing a local attorney about your options in dealing with your debt issues.
