Legal Question in Credit and Debt Law in California

Spouse passed away, but found out that he has an abstract judgement on the deed that is a joint tenancy.

1) Can we obtain information to validate it if it's from 5 years ago?

2) How is the best way to handle this if we were never aware of the situation?

You are in a rather complex and arcane area of land title law, as well as enforcement of judgments. There is a lot of information a lawyer would have to get from you before even beginning to answer your question on how to handle the situation. How to get information is simpler but not simple. You would need to obtain a copy of the abstract from the county recorder and then take the case number to the court clerk in the court that issued it and pull the file for the case. If he didn't even know about the case before he died, you can probably have it thrown out, even at this late date, but you will have to act quickly. Again, you're going to need a lawyer.
