Will a judgement be granted at an OSC 3.740 hearing if I havent bern served yet?

If a rule 3.740 hearing is being held it is because the court not only thinks you've been served. Not only that, the attorney for the creditor has taken your default for failure to respond. The court wants to know why he or she hasn't taken the next step of getting a default judgment. You are in deep trouble at this point unless you just want to have a judgment entered and/or declare bankruptcy.
