Legal Question in Criminal Law in California

about a couple years ago i was released from LA county jail after serving 7 months for grand theft. i was released on 3 year probation and 3 year joint suspension by the torrance court

a year later my stupidity led me to commit a very similar crime, i was arrested by the long beach court and they're sentencing me 30 days for it. i've already served most of it before i posted bail but i decided to miss the court date and now i'm currently on the run. i have not been reporting to torrance probation as well because of this. i'm scared to take the sentence/conviction because that will automatically violate my joint suspension with torrance.

any legal advice would be greatly appreciated! i'm tired of running and i'm ready to turn myself in. should i turn myself into long beach courts where i'm wanted, or torrance probation? or even the courts at torrance (which may not make sence, since they probably don't know i'm wanted but i want to take my prison sentence ASAP and get it over with.). Also since I served 7 months on the first crime, is it true that those 7 months are credited towards the 3 year joint suspension? And am I still allowed half time, or is it true if you violate joint suspension you have to do the full time? Once again, any type of advice would be appreciated. Thanks ahead of time!

Here is where I am a little confused... Usually, the DA runs a background check and there is a probation report. Based on the probation report and the background check the DA should have known about your previous felony and the 3 years joint suspension. The 30 day offer may have been in exchange for the 3 year suspended sentence.

You may have dug yourself a bigger whole by running as the 30 days may have been it. You should really look into hiring an attorney to try and fix this matter for you.

I would definitely need more information to give you a better analysis.

If you would like a free consultation, please feel free to call me.

The best option would be to go to Long Beach court with a lawyer. If you don't have the ability to do that, you could turn yourself in at LA County IRC on a weekday evening (why ride buses if you don't have to?) and they would probably send you to Long Beach the following morning to face the music. I would wait until after the holiday weekend to do this. I have no idea what will happen with your joint suspension. Maybe you will get lucky due to prison/jail overcrowding.

Of course you should address the issue. You should seek help from a qualified attorney who will try to avoid the 3 year joint suspended sentence. You can go over all the facts and see the best course of action. I wish you well. ................. David Wallin
