Legal Question in Criminal Law in California

diversion

I was convicted of a first time minor possession charge - I plead guilty and was sentenced to diversion. In that interim I was unable to even sign up for it. I lost my house and was forced to move out of county where I have no transportation other than a bike. I have not received no new charges to date. Will they reinstate diversion due to hardship or what is my next move. I am a 47 yr old female and cant think that jail is the best solution. What is your advice?

You need to get yourself enrolled in the drug diversion class and/or in compliance with your probation terms asap. You will need to contact the probation department and let them know your situation. Depending upon the drug diversion program, you may have a probation violation pending against you. One of your probation terms would have been to keep the court informed of your address at all times. Any notices will be sent to your last known address. You will likely need a re-referal to the drug offender class from the court. Contact your public defender or an experienced criminal law attorney to assist you.
