Who is eligible for Drug Rehab (prop.36)

A friend was arrested for Poss. of conrolled sub, Poss. of conrolled sub. for sale (about a 1/2 oz. of meth.) and also 1/2 oz of marjana. He has never been arrested for drugs before. He was told in court that he didn't qualify for prop. 36 (drug rehab) because he had to many charges. We would like to know the law. Would like to Thank You in advance, Debora

Prop 36 benefits are generally not available to individuals who sell drugs or have been convicted of a violent crime. Your friend needs to be represented by an attorney, as he is facing a state prison sentence if convicted of selling drugs.
