Legal Question in Criminal Law in California

joint suspension

I have a neighbor that has a joint suspension for assult and battery. They are also on probation for 3 years for a DUI. They recieved a 2nd DUI which is also a violation of the probation. Will they hold up the joint suspension or will they walk away without doing time. I have to know because they are harrassing me and I need to know if I need to file a restraining order. The joint suspension is for 4 years.

It's anybody's guess. My best guess (not knowing anything more than what's in your question, and not knowing where you are) is that he will do some time. If you file for a restraining order while he's in, he won't be able to appear in court to oppose it.
