Legal Question in DUI Law in California

Cops came to my door saying got a call that my boyfriend was driving dangerously and making threats to other car. My boyfriend did go out for food an the truth he was a little intoxicated, he came home about 20 min later cops came in. After coming home he started drinking even more, so by the time cops he was serous drunk. He got a ticket for dui and our car got towed away. But how can he get a ticket if he was at home he wasn't driving, he wasn't stopped on the road, he was dragged out of the house. And the car was parked safely it shouldn't have been towed away. There was no proof of him driving drunk. Except that he told the cops he had been drinking, but he was intoxicated and confused and got threatened by cops. I don't think this is right . Please help. Can we fight this dui?

This is a ticket you should fight. The Officers never saw him drive and do not know his drinking pattern. Get an attorney!

In addition to the advice you have already received, do not discuss the facts on-line. They can be used against your boy friend and result in you being subpoenaed. Discuss them only with a lawyer.
