Legal Question in DUI Law in California

Sealing felony records

I have a felony DUI in California and live in MS and want to know who to get criminal records sealed, so that I may apply for a better job that does not allow applicants with a felony. What steps can be taken to have the records sealed.

For a motion for reduction of felony to misdemeanor or an expunging of records a motion may be made at the court of jurisdiction. Call me directly at (619) 222-3504.

Re: Sealing felony records

Thank you for your posting.

California law doesn't allow for felonies to be sealed, per se, but you can apply to the court to re-open the case, have it be considered a misdemeanor, and then expunge it, which will remove it from your record, OR you can apply to the California Governor's Office for a pardon. Pardons are called "a Certificate of Rehabilitation", and that takes you away from any consequences of a completed felony that is old.

I hope that this information helps, but if you have further questions, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. I am happy to help in any way that I can.

Re: Sealing felony records

Depending on some things you don't mention, you may be eligible for expungement relief pursuant to Penal Code section 1203.4, which allows you to deny that you have been arrested and convicted of the offense for the purpose of applying for a job. There are some exceptions to the general rule that you can deny the conviction, but for an application for a job, the protection of 1203.4 is pretty clear. If you'd like to proceed on this, don't hesitate to give me a call. Steven Mandell, Santa Monica, CA 310 393 0639
