Legal Question in Family Law in California

After 25 years of marriage my husband and I separated. He filed for divorce and two weeks later we were back together so I did not respond. WE soon remarried and now 19 months later he has filed for divorce again but this time I am responding with spousal support and some of his different retirement monies. We decided when we were raising our children that his work would be his priority and mine would be the children and household. His lawyer says that I can only collect on the last 19 months and no pension. He makes 3400 a month and Iam bringing home 800. I filed for emergency spousal support but ran out of gas on my way to the hearing so was denied. Does anyone know of a case similar to mine that I can use as a precedent at the hearing? I dont have a lawyer like him so doing it all myself. We live in California

Your question is a little bit vague. It sounds like the first divorce action never went further than an original filing. If that matter was dismissed, then the first filing should have no impact upon calculating the property rights to which you are entitled.

You should be able to find an attorney in your location willing to meet and discuss your case for little or no fee. You will need an attorney and you may be able to get an order that your husband assist in pay for your attorney. Do not deal.
