Child Care cost

Mother lives in CA, and has full custody of 1 yr old, with no visitations to father. Father left mother 6 mos pregnant and moved to NC. Father is court ordered to pay $411.00 a month in child support, and is garnished when he's working. Although he continuously changes employer. For 3 mos mother did not receive child support and had to pay childcare cost with a credit card.

Mother works full time, and has 2 other children from a different father that does not work there for mother does not receive child support for those 2 children.

Childcare cost for the 1 yr old is $650.00 a month, and $480.00 for one of the other children.

Can mother sue father for half or all of childcare cost, for the 1 yr old?

If the Court did not order the father to pay 1/2 of the child care in the original support order, than you could do an OSC to modify the existing order and request that he be ordered to pay 1/2 of the child care for the 1 year old. Furthermore, you could also do an OSC RE: Contempt for the support payments that the father missed. You could ask for attorneys fees, interest, and sanctions on such a motion.
