Legal Question in Family Law in California

child support

my husband previously got physical custody of his 2 children. He was giving his ex-wife 1500 a month of child support. Now with these changes, they agreed upon $700 of spousal support for 1 year. She lives with her boyfriend, small child that's his and another 15 yr old from another father. She wants more money from my husband and is threatening him to take him to court for child support. The children are with her tue & thur after 6:30 pm and every other weekend. Can she get more money and will my husband have to pay her attorney costs again if she does take him to court?

Re: child support

I cannot answer your question regarding child support without knowing what her income/earning ability is and the same for him. Also there are issues of interest and prop tax deductions for each party, health insur premiums and the type of income rec'd by each party.

If she is living with her boyfriend, your H would have the right to ask the court to reduce or end the spousal support.
