Legal Question in Family Law in California

day care cost?

I recently went to court for child support and child custody. Before the child custody hearing the child support was ordered. The order was that father pay for half of day care.

Later the child custody order came in (these were two differ courts, two differ orders)and it was ordered that we share all breaks.

Father decided that because he gets half of breaks he no longer needed to pay for day care during the breaks.

Is this how it works? Because he now gets her for half I'm responsible for my week and he's responsible for his?

My concern with this is that I know during the time that he has her he does not have to worry about child care because he has a stay at home girlfriend that cares for the child they have together and therfore she cares for the daughter him and I have together.

Re: day care cost?

The court order that he pay one half of the child care cost remains in effect until the court changes it. Often you cannot get child care for two weeks out of the month. In my experience, which is limited, you must pay for the entire month of child care regardless whether or not the child is in attendance.
