First, serve your ex-to-be as quickly as possible and make sure the process server promptly files the proof of service. If the ETB fails to file a response by the time required, file a request for default immediately. Expect the spouse to fight that, but if they do they will have to file a response. Once the response is on file, check your local rules and talk to the Family Law Facilitator, or Family Law Self Help office at your local court to find out what the local process and procedures are for getting a case set for status and settlement conferences and trial. Then meet all deadlines, file all papers required by the rules on time, and show up to court for all scheduled hearings. If kids are involved, be sure to make an orientation and mediation appointments as soon as you have served the ETB.
Keep in mind you cannot get your marriage terminated any earlier than 6 months and a day after you serve the petition on the respondent.
The best thing to do is have the papers served promptly and properly. Then watch the time frame for your spouse to respond, and timely take the default if necessary.
