Legal Question in Family Law in California

My husband is using marijuana to self medicate. He has been in trouble at work for his temper. He was diagnosed as depressed and told to seek counselling. I have tried, repeatedly to help him. We have a one year old child and he has a 9 year old son from a previous relationship. I have been a stay at home mom. I have limited resources. I need to leave with full custody of our son, until which time he gets the medical help he needs for his depression and addictions. How do I legally do this? My entire family is in Ohio. They have offered any and all assistance to help me and our son. Can I leave with our son? What do I have to do?

File and serve your divorce petition with a motion requesting that you move with the child. Also request supervised visits with father until he demonstrates continuous sobriety and is recieving help to deal with his anger and depression.
