Legal Question in Family Law in California

Mother had stroke

My mother loved with me, she gave me her signature for her funds to go to a Wells Fargo account. She paid $300 for rent mothly and I would give to her $300 to $400 a moth for monthly expencess, depending on how much she wanted. In Aug. 2007 mom had a storke that part of her momorie is gone. My sister that is married to her uncle took her sicne I did not have any legal papers to keep her with me. Now they want the social services to investigate if I for some reason have any of her money? Can they sue me for money that I do not have? I did not maintain records of her money. As I usually do I shredd records after a period of a month or two. Even my own. What I do have is the verbal agreement that my mother and I had when she had full consuse of her actions. Is there anything I can do to procet myself legally?

Well, they can certainly sue you. However, that doesn�t mean that they will win or receive a money judgment against you, but they can sue you. I am not sure what you mean that your mother gave you her signature and then you say that you had a verbal agreement to withdrawal funds from her account. It sounds like you sister is concerned that you may have stolen money from your mothers account after her incapacitation. In terms of what you should do to protect yourself legally, I would start out by at least talking to a lawyer and discussing the facts in more detail.
