Legal Question in Family Law in California

Pension Lump Sum Payouts

I divorced my ex. in 1999. last year (2008) I was awarded 50% of the total value of the pension which exceeds $205,000.00 the holder of the pension has now said they will not payout my portion until he's eligible somewhere between the ages of 55-65, he's currently 45. My question is, if the judges order says I shouldn't have to wait for this age stipulation, is there a way I can get access to these funds before then other than his demise?

Re: Pension Lump Sum Payouts

I would like to see the order. Was the employer joined in the action for a QDRO? It would be very unusual to have a payout earlier than retirement. Contact me directly.
