Legal Question in Family Law in California

Can police take my fiance into custody for suspicion of abuse even if he is innocent? If he was not home when they came to look for him, does he have to go, or does he wait for them to come again?

He does not have to be home when the police answer a domestic violence call. They can arrest him if they have probable cause to believe that domestic violence has occurred.

The police came to either investigate about a claim that he committed domestic violence, or because they have a warrant for his arrest. He should contact an attorney regarding this matter. Talking to the police is a bad idea.
