Legal Question in Family Law in California

I have been served to modify child support. How do I request a change of venue (court appearance scheduled for N. CA, I have lived in S, CA for 7 years now, other party lives in different state) and a continuance? Which should be filed first, continuance or change of venue?

A change of venue would result in a continuance, but you don't provide any facts that indicate a change of venue is appropriate. In fact, it appears that the parties had what is called a "move away" case and did a move away without court permission. I suggest you speak to a competent family law attorney immediately.

You should request both at the same time. I do not agree that the request is necessarily a move away request, which is a complex issue. If you will fax to me the moving papers of the other parent along with a copy of your current order, I would be happy to give you a free phone consultation.
