Legal Question in Family Law in California

I've been with my significant other for awhile. She moved in just over 8 years ago. We have two young kids. We don't get along and she has no interest in counseling. Not married but we did have a wedding ceremony, paperwork was screwed up.

House is in my name, I pay mortgage and all house hold bills. I work at home and more often than not I'm the one making meals, grocery shopping, driving kids to and from their school and activities, etc.

If this doesn't get resolved, where does that leave me? Can I get her out of the house and custody? Primary custody? She couldn't afford a similar home in the area on her own.

I am lost.

More information is needed about your situation. Does your ex believe that there was an intact marriage? A lot of factors may control the property division if she in good faith believes that the marriage was completed as it relates to property division.

With regard to the children, their placement has to do with their psychological attachment to the parents and in their best interests. Property ownership and the economic situation of a parent is not the controlling factor.
