Legal Question in Family Law in California

I have sole custody of my son, 13 years old since he was 3. My son's father has not supported my son since then (2005) and has no spoken to my son since the Spring of 2008.We, (I, my son and my husband, his step father) want to do a step parent adoption. How difficult will that be if the birth father blocks this? We currently live in California (the sole custody decree took place in Oklahoma).

The legal approach that you would pursue would be a petition to terminate parental rights in a petition for stepparent adoption. This area of law is complicated. You and your current spouse should meet with an experienced family law attorney to explore your options.
