Legal Question in Family Law in California

unwed American mother, Italian father

I was living in Italy with my ex boyfriend. during an argument he slapped me for the first time. he said i provoked him. i did not photograph the bruise, but his sister saw it. he claims that i am mentally unstable. a few days later I left without telling him for fear of my safety. I am in California now. He knows that I am pregnant. Is it best to name him on the birth certificate? What custody rights will he have? I am currently unemployed, can I claim child support? Can I request full custody?

Re: unwed American mother, Italian father

Since you were not married he would have no parental rights until there is a determination that he is the child's father. You can request child support, that will require a determination of paternity. Once paternity is determined he will have all of the rights of a father.
