Legal Question in Family Law in California

My wife has kids from here previous relationship (never married) in California. I'm in the service and stationed in WA. My wife is pregnant can she put a move away order and move to WA? She is court ordered to not moveaway from the seven counties of southern california.

She certainly would have grounds to seek a modification of the order to allow a move away. Whether it would be successful or not depends on way too many factors to get into on an internet Q&A service. She should talk to a local Family Law attorney.

I would agree with Mr. McCormick. In a move-away request, better to file as soon as possible as the courts will usually order psychological testing. A big factor will also be the degree of the father's involvement with her other children. It is highly suggested in move-away cases to have legal counsel.
