Legal Question in Medical Leave in California

Intermittent leave and doctor verification

I have an employee eligible for intermittent fmla to care for her mother. She has missed 10 working days. Our rules require Doctor certification for absences over 7 calendar day. Can we require something from her Mother's Doctor saying the mom had surgery and the employee had to attend to her Mother?

Re: Intermittent leave and doctor verification

Yes, employers can require 'reasonable' evidence of qualification and compliance. They can't pry into personal details, but can ask for general acknowledgment from doctors, just like with WCAB.
