Legal Question in Medical Leave in California

What are my rights pertaining to notification to my employer

Am I responsible to provide a doctors note or explaination of my reasons for being out of work, everytime I'm out of work, if I have been granted FMLA?

-The employer may ask for a doctor's note when you return from FMLA leave. I do not think their is a clear answer when the leave is intermitent.

Re: What are my rights pertaining to notification to my employer

An employer may require that you provide them with a certification by your health provider the following:

1. The date on which your serious health condition commenced;

2. The probable duration of the condition; and

3. A statement that, due to the serious health condition, you are unable to perform the function of your position.

The employer may not require you or your doctor to inform them of the nature of your health condition. That is private.

However, more specific to your question, the employer does have the right to ask for subsequent updates from your health care provider if additional leave is requested.

The employer may also require a verification from the health care provider that you are able to resume work, when you are ready to return.
