Legal Question in Civil Litigation in California

if a contract is formed by two individuals (and both parties signs) and the contract is based on future payment's that are not a guarantee ( other party is fighting for a settlement from another case, If he wins I am awarded money but, if they do not, then I will not receive money), but if this person breached on another area of the contract, would I still be able to file a "breach of contract" lawsuit, although there is no guarantee that I will receive any money anyway?
