Legal Question in Civil Litigation in California

i recieved this from a person who is talking about a 220 dollar bicycle i left at his house. "just wanted to let you know that time recently at jasons when we all got hash i stole a fat chunk from your jar and packed it in the bong and didnt let you het it and your bike is missing from my place, yeah fuck you thief! thats just a little revenge for what you've stolen from me and my dad, fuck with me more and there will be violence guaranteed." i have contacted the police for a restraining order but i want to know if i can take this to small claims court since he admits having my bike and disposing of it.

Reporting the your bicycle is missing is not a confession he stole it. You could sue arguing he was negligent in not keeping it safe from being taken.

When you appear in court,if you or the defendant brings up the fact that you were using hash, it is possisble that you might get arrested.
