Legal Question in Civil Litigation in California

senior citizen, no assests being sued by credit card company for $4100. needs to file "answer" to summons, what do we say? Senior currently going through Chemo - very poor health.

File a general denial. Even though you have no assets, you don't want them to take your default and obtain a judgment. They will then be able to go after any assets or income that you may have, causing you to have to go to court to fight it. At least file a general denial and then explain to the attorney who is helping the company that you don't have any assets and that you are in ill health. They aren't going to go after someone who has no money and no assets.
