How do I sue for damages in a case where the local PD shows no desire to press charges even with credible eye-witnesses?

You don't need a criminal prosecution in order to sue for damages in a civil proceeding. If your claim is under $7,500, go to small claims court (the clerk with give you an information packet about how to prosecute the case). If it is larger than that, consult your county bar association's Lawyer Referral Service for names of lawyers who may agree to handle your case.
