Legal Question in Immigration Law in California

I am a US citizen, and my girl has 5 months to go until her OPT expires. When is the latest we need to file for marriage so that she won't be forced to go back to her country of citizenship? We want to get married anyway, and it's ok if we have to marry earlier because of the OPT expiration, but we are procrastinators (haha) and are wondering what is the latest time we need to apply for marriage? Thanks a bunch!!

You need to do so as soon as possible so that she is not out of status for long (once her status expires). For assistance with this matter, please contact my office at 1-800-408-5818 or email me at [email protected]..

She can remain legally in the U.S. and be free to work and travel as well if the sponsorship paperwork is properly filed prior to OPT expiration. Since it can take 3 months for employment authorization document (EAD) after filing, it is a good idea to file at least 3 months prior to OPT expiration so that there is no interruption in her employment, if applicable.
