The I-130 petition is taking 5 months at the CA Service Center. Once approved, the backlog is about 2 years. Therefore, your spouse must remain in valid, non-immigrant visa status in order to be able to adjust status in the United States, once the priority date becomes current. If not, your spouse can only adjust status once you become a U.S. citizen.
