Legal Question in Immigration Law in California

My fiancee is on a work visa from Japan, she has had to move to Dallas, TX for her job. Is the process for having her here on a K-1 visa (not yet applied for) the same as if she was in a foreign country? If we get married soon, will she have to wait to quit her job before coming to live with me in San Francisco until she is granted a K-1 visa? Please help!!! Thanks

If she is in the U.S. on an H-1B visa, there is no need to do anything else. You can get married & apply for her greencard.

K-1 only applies when the person is outside the U.S.

Pls let me know if you have any questions.

Good luck to you both.

If you plan to get married soon, it might be better to file the immigrant petition instead of K-1. We suggest you to consult with an immigration attorney to discuss the options.
