Legal Question in Immigration Law in California

my girlfriend is currently here in california as a student with her f1 and her I-20. we were planning to get married anyway, but due to some complications at school she is going to lose her status and have to go back to china. so we want to jump ahead in our plans and get married as soon as possible. what do we need to do to avoid having her go back home.

You need to expedite your plans and proceed with the application before she falls out of the status.

As long as you are a U.S. citizen & she had a lawful entry, you can file for her immigrant visa as soon as you get married. Even if she falls out of status, she will still be eligible to adjust status based on marriage to a U.S. citizen.
