Legal Question in Insurance Law in California

Brain injury, L. A. Co. employee, HELP!

I need help. My husband had a serious car accident last May. He sustained a brain injury and isn't ready to returned to work just yet. I am overwelmed with all the forms for his disability insurance benefits, suplimental disability, AD&D, leave of absence, and any other benefits he has coming. What kind of lawyer am I in need of?

Thanks in advance

If your hasband has a lawyer for his car accident, then you may consult him/her about the different forms for benefits. If you haven't got a lawyer, please feel free to contact me for a consultation. My office routinely assists our clients free of charge that are of a secondary nature, unless they deny the benefits, in which case we litigate.

I hope he recorvers fast and good luck.

You need to look for a lawyer that has experience with serious injuries, with disability insurance, and will spend the time with you to help you and that you feel comfortable with talking about all of the issues you need to take care of.

I suggest you call and make appointments with several attorneys and get references and check them out. Meet with them and talk with them and then make a decision as to whom to hire based on your level of comfort and their references after your interview.

There are many good and reliable lawyers but a quick decision could get you with someone that will not take care of all of the issue you may need to deal with.

Members of the Consumer Attorneys of California would be a good resource to start getting names. That membership should appear in their adds.

You are wise to get help.

Try the employee benefits department of where he worked, or contact the insurance agent (not the insurance companies) who sold the policies. They can assist you.

You really do not need a lawyer. A capable CPA would also do. But if you do go to a lawyer, hire one by the hour, not by a percentage of the benefits. No company has denied any benefits so you don't need a "litigation" attorney. If that situation changes, then so might this answer.
