Legal Question in Intellectual Property in California

How do I find out if "Segway" is in the public domain so I can use it in my marketing materials for a device that is "segway-like" or a "mini-segway."

It is unclear exactly what you are asking and of course reinforces the good practice of consulting a lawyer in private especially before you start spending money. Are you saying that you are seeking to use the term "Segway" as a trademark? Or are you seeking to use it descriptively in text such as "our product is comparable to the Segway?"

Before you do anything, I suggest that you consult with a lawyer in private and discuss your objectives in more detail. You can start by calling around to several for a free phone consultation, get some insights then pick the best fit to work with.

If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient.
