Legal Question in Intellectual Property in California

My mother gave me a cellphone for my birthday and put me on her cellphone plan in her name. I have been paying her monthly but she hasn't been paying the bill and now wants to take it back because she cant pay her end of the bill. I then payed for the entire bill giving her 420$ in cash when I owe her 40$ a month. Still she disabled my phone and still wants it back because we had a falling ou. Do I have to give her the phone back or can I keep the phone and get a new plan?

Since the cell phone itself was a birthday gift, you are entitled to keep the gift. If you are old enough to get your own cell phone plan, that sounds like a good idea. Make sure that you keep your payments current so that you can establish a good credit rating.
