employer not paying me

I haven't been paid in six weeks. There is always an excuse. The man with the check is sick. The check was made out wrong. They owe me $5,500. I can't pay my bills. What can I do?

The Labor Commissioner's office investigates wage claims. Penalties attach to late-paid wages.

If you are a non-exempt California employee (ie-entitled to receive overtime, etc.) then an employer does not have discretion to withold your wages. California Labor Code Sections 201, 202 and 203 address this issue. You have the option of filing a claim with the labor commission (DLSE) or proceeding to State Court. The law is on your side!
