Legal Question in Employment Law in California

I feel I have been harassed and am currently being retaliated against by my manager at work for turning him in to our plant manager, but really like the COMPANY I work for.

I am a 36 y/o female and work in Aerospace and was hired on as a Mechanical Assembler for my company. I am one of only 2 female mechanical assemblers in my facility. The other female mechanic being over 70 years of age. It all started about a year ago when my manager took over supervisory duties for my supervisor, who went on bereavement. Up until that point, I had been assigned misc. tasks by my supervisor in preparation for the launch of my dept, and performed those tasks not only without complaint but even caught a few errors that were missed by our engineers. That is not to say that my supervisor didnt counsel me when needed for other issues, however in regards to my actual work performance, she ( my supervisor) was pleased. Such tasks included documenting and placing requests for tools and equipment that would be needed for me to sucessfully perform my job, receiving weighing, and maintaining inventory of parts and hardware that came in, labeling and organizing shelving and bins for parts and hardware storage, assisting in the planning and layout of my dept,

Prior to reporting my manager I have tried:

Talking to my manager about why he treats me ther way he does

Ive tried adjusting my communication so as to eliminate any miscommunication btwn us

Ive tried discussing issues bothering me with my SUPERVISOR and seeking advice from her

Ive solicited advice from another team member as to how I feel

And Finally I reported him (my manager) to our facility plant manager. I dont know what else to do without jeopardizing my employment more than I have already.

Other than the coincidence that you are female, you said nothing that would indicate 'illegal discrimination' based upon gender.

Not only are there no laws against poor management, 'unfair treatment', or rude and obnoxious behavior, but in general unless an employee is civil service, in a union, or has a written employment contract, they are an 'at will' employee that can be disciplined or fired any time for any reason, with or without cause, explanation or notice. That is, UNLESS it is based upon discrimination, harassment or retaliation as defined as actually illegal under the ADA [disability], Civil Rights [age, race, sex, ethnic, religion, pregnancy, etc], FMLA [medical leave], Whistle-blower, or similar statutes.

Any employee's goal should be to keep their supervisors happy and make them look good to the company, and make the company money. Thats how the company pays employee wages. If you don't, then don't be surprised to be replaced.

Now if the conduct is illegal under the above definitions of discrimination, feel free to contact me for the legal help youll need. The discrimination laws protect you whether in a union or not,.
